Terms and Conditions
These are the terms and conditions under which The Vintage Trader ("we" or "us") supplies furniture and home accessory products (the "Product") or services ("Services'") through its website www.thevintagetrader.co.uk to you (the "Customer" or "you").
Each Customer should ensure they read these terms and conditions prior to placing an order with us. Please note by placing an order for any Product or Service from The Vintage Trader, you agree to be bound by these terms and conditions.
1. Order Process:
Once a Customer places an order with The Vintage Trader, the Customer will receive an email receipt to acknowledge The Vintage Trader has received your order and payment.
2. Description of goods:
We endeavour to describe all items as fully as possible, to the best of our knowledge, providing as much history, age and detail as is known to us together with a full description of any discernable defects or faults. However, it should be noted that the items that we are selling are antique or vintage items and as such, may in some cases have some age-related wear.
They are not presented in 'perfect' condition; each piece has its own story to tell and the bumps, scratches and marks picked up over the years add to the patina and history of the piece. We provide a full description, high quality images from several angles and measurements to show each Product as accurately as possible. Despite this, some small variations may occur (e.g. colour). If you require further clarification of a Product please contact us for further information. It is the Customer's responsibility to ensure the condition and presentation of their purchase is satisfactory for their personal requirements.
3. Electrical products:
We recommend that all electrical goods are inspected, tested, certified and installed by a qualified electrician. We also recommend that vintage electrical goods are protected by a "RCD". We will not be liable for any loss, injury or death caused by electrical goods that have not been inspected, tested and certified by a qualified electrician
4. Refund Policy:
We realise that making purchases online is not easy when you haven't seen or examined the goods. We are happy to discuss items in more detail and, if required, will provide more detail on condition along with photographs.
We want you to be pleased with your purchase, but if you are unhappy with it we would like you to get in touch with us. We will provide a full refund of the purchase price (excluding all transportation costs) if the item falls short of your expectations, providing the item is returned to us in it's original condition, and within seven days of your receipt of it.
5. Shipping:
Smaller items will be packaged and dispatched within 3-4 days of ordering if not sooner. These items are shipped, fully insured and with tracking numbers, via our designated courier Fed Ex or the Royal Mail. In most cases, a signature will be required upon delivery.
For Furniture Products we use reliable national couriers who deliver to mainland UK. The Vintage Trader prefers to arrange delivery within 7-14 working days wherever possible. In order to keep delivery costs as low as possible we either arrange delivery ourselves or use a local trusted courier company. We arrange the quote and once accepted by you, pass your details onto the driver who will then make contact with you to coordinate delivery times directly. You will need to pay the driver upon delivery. Insurance of all items passes to these delivery companies as soon as these items leave our premises. We will obviously be happy to assist you with any queries/issues you may have regarding delivery.
Alternatively customers are always welcome to collect their purchases from us directly.
It is the responsibility of the Customer to make sure the Product(s) ordered will fit through the delivery route into the desired room in their property. Each product description includes the height, width and depth so please ensure you check this before ordering. Delivery is 'kerb-side only' and the Customer is responsible for arranging appropriate transfer into their property.
6. Pricing and VAT:
a.The Vintage Trader is not VAT registered so is not obliged to charge VAT. Prices quoted by The Vintage Trader do not include delivery charges unless otherwise specified. Prices may change at any time without notice.
b.These prices exclude delivery costs, which will be added to the total amount due. For the avoidance of doubt, we will not be liable for any export or import duties, taxes etc. arising as a result of the goods being sent to a destination outside the United Kingdom.
7. Liability:
The Vintage Trader's liability for losses is strictly limited to the amount paid by the Customer for a Product or Service. Neither The Vintage Trader nor any director, employee, affiliate or other representative will be liable for any loss, damage or expense arising out of or in connection with the supply of goods or services offered through this website including but not limited to indirect or consequential loss or damage, loss of data, income, profit or opportunity, loss or damage to property and claims by third parties, even if The Vintage Trader has been advised of the possibility of such loss or damage and/or such loss or damage were reasonably foreseeable. The exclusions above and limitations of liability shall not apply in respect of liability in negligence for death or personal injury.
8. Amendment to Terms and Conditions:
The Vintage Trader reserves the right to amend these terms and conditions at any time without notice. If you have any comments please send them to [email protected]
DC LTD ADVICE:
It is the individual Dealers responsibility to make themselves aware of what the Distance Selling Regulation rules contain; these regulations are open to change, may vary and are detailed, so you may wish to familiarise yourself with such via the many websites available to you on this subject.
Your contract of purchase is between the Client and the Seller, not the Decorative Collective Ltd, we are just the introductory agent. Your rights include, but are not limited to the below. You must check with each individual Seller what their own terms and conditions are and what their own purchase and returns policy include. The DC Ltd is not responsible for the description, condition or attribution of an item as we do not have sight of any item and do not have physical ownership of any item, but we do endeavour to only allow professional and experienced dealers onto our website. We do not collect payment or hold such unless specifically agreed prior to purchase and then only as Agent do we hold funds, which are held by the DC Ltd until both parties have confirmed such can be released. If such funds are held and an item is returned, release back to the client of such funds, will be subject to the Seller confirming the item has been returned according to their returns policy. Items are not released to the Buyer until the agreed payment is received by the DC Ltd. The DC Ltd is not responsible for any related bank charges, transfer fees, currency fluctuations or otherwise. You have the right to return items purchased via the internet up to 14 days following receipt of the item to the specified delivery address. If you collect an item in person or arrange your own delivery, then this term starts immediataely you or your carrier collects the item (this is to avoid your own carrier sitting on the item for a long time before delivering it).
WHAT WE RECOMMEND:
Always ask for an invoice from the Seller. On the invoice you should have the date of the item, any provence, full description, including any restoration or damage. It should state terms of payment and delivery and returns. It should also show the business name, business address, contact numbers, email address and VAT number if applicable.
You should ask for confirmation of your purchase by email so that you have written proof of the agreed price, any additional charges, eg delivery and if you are having the item delivered, ask how and who will be undertaking it and what the Sellers return policy is.
Ask for email confirmation of what your responsibilities are should you wish to return an item, including re-packing, how you must confirm your desire to return the item, eg email or by telephone and be clear on the Seller's return policy.
The prices indicated for items on this site are correct at the time the item is listed, barring any error by the Seller. However, the Euro and Dollar prices shown are for indication only and may vary as rates fluctuate and you may incur your own bank charges when making payment from abroad.
VERY IMPORTANT:
Some of our Dealers (Sellers) are based in Europe so you may need to qualify with them their specific purchase and returns policies. However Distance Selling Regulations apply througout Europe as far as the DC Ltd is aware.
Please do not be concerned about the above statements. They are there to help and protect both parties and should help to avoid any disputes by making things clear. The owner of this site, Jane Walton, is always happy to help and assist where possible and clients are very welcome to contact Jane should they need advice or assistance. Being a dealer herself for 16 years, she knows that most dealers are good, hardworking and professional people who understand the rules and how to be polite and helpful to clients at all times. They can help you obtain shipping or transport quotes for example. Never be worried about speaking to a Dealer and asking as many questions as you need to about an item, they wil be happy to help you. Please do remember though, that they will always be more receptive to clients who show them the same respect.
